Lamar Odom Won't Sign Divorce Papers, Kardashians Haven't Heard from Him in Weeks

What the Kardashians want, they usually get. But it's easier said than done in this case.

When Khloe Kardashian filed for divorce from Lamar Odom 10 months ago, she was finally ready to move on.

But the former NBA player, 34, isn't making it easy for the reality star, 30, to enter the next phase of her life. Odom has yet to file his own response to Kardashian's initial divorce filing – and in fact, has not been seen or heard from in several weeks.

"He needs to sign papers and he won't," a source close to the Kardashians tells PEOPLE. "He disappears here and there, and she can't find him. She just wants to move on."

According to papers filed by a Los Angeles Superior Court Family judge on Oct. 9, Kardashian must now make a choice – either file a Request to Enter a Default, or a Request for Dismissal.

Request to Enter a Default is used either when a spouse who has been served fails to respond within 30 days, or the respondent spouse cannot be located.

A Request For Dismissal is used when one or both parties decide to essentially cancel the divorce filing altogether.

Should she be granted the Default, Kardashian would be able to go ahead and get the divorce, even without Odom's participation. According to a California divorce attorney, "as long as there are no properties or children between the two parties, one person can't stop the other from getting the divorce just by not showing up."

In her initial filing, Kardashian did not request spousal support from Odom. However, she did ask to terminate the court's ability to grant spousal support to Odom – and that they each pay for their own attorney fees.

The divorce filing came after years of hiding Odom's drug abuse and infidelity from family and friends.
